Spousal Support
The purpose of spousal support is to assure the dependent spouse (that is, the spouse who earns less) a reasonable living allowance. The duty to provide spousal support arises out of the marital relationship. However, a spouse may forfeit the right to support by engaging in certain misconduct.
The actual amount of spousal support is calculated through application of the Pennsylvania Support Guidelines. Rule 1910.16-4 sets forth the calculation used to determine a spousal support award. This calculation determines the spouses' monthly net incomes. The difference between those two amounts is multiplied by a percentage to arrive at the amount of the award. Certain adjustments may apply.
Spousal support payments are deductible from the payor spouse's taxable income for federal income tax purposes. They are likewise includible in the payee spouse's income for federal tax purposes.
A factor that is considered in making a spousal support award is the length of the marriage, from the date of marriage to the date of final separation.
